The terms that apply to this website and to work we carry out for you.
These Terms govern your use of the Magna Integrated Services website and any work we carry out for you. By using this website, submitting a form, or engaging us, you agree to them. If you don't agree, please don't use the site or engage our services.
Where you sign a separate written quote or contract with us, that document governs the work. These Terms fill in anything it doesn't cover. If the two conflict, the signed document wins.
Magna Integrated Services (BIN 1001690057) is a sole proprietorship registered in Ontario, providing commercial and residential building services in Durham and York Regions, Ontario.
Our services include:
Work is carried out to manufacturer specification and applicable Ontario Building Code requirements. We are not the manufacturer of the products we install.
Quotes are based on what we can see and what you've told us at the time. They're valid for 30 days unless stated otherwise in writing.
Some things can't be known until work starts — rot behind cladding, a frame that isn't square, substrate that won't hold. Where we find something like that, we stop, tell you, and give you a revised price before continuing. We don't carry on and add it to the invoice.
If you are a consumer (that is, the work is for personal, family, or household purposes rather than for a business), Ontario's Consumer Protection Act, 2002 applies. Under it, we cannot charge you more than 10% above the written estimate we gave you. If the work needs to exceed that, we have to get your agreement to a new estimate first.
You're responsible for giving us safe access to the work area at the agreed time, and for moving or protecting valuables, vehicles, and anything fragile nearby. Where a property is tenanted, arranging tenant notice and access is the property owner's or manager's responsibility unless we've agreed otherwise in writing.
Exterior work depends on weather. We'll reschedule rather than install in conditions that would compromise the result, and we'll tell you as early as we can.
Any change to the agreed scope — by you or because of conditions found on site — will be priced and confirmed with you before we carry it out. Verbal approvals will be followed up in writing.
Payment terms are set out in your quote or invoice. Deposits may be required on larger jobs or where materials are custom-ordered; where that applies it'll be stated in the quote before you commit.
Invoices are due on the terms shown. Overdue accounts may be subject to interest at the rate stated on the invoice, and to reasonable collection costs. We may suspend work on overdue accounts after giving you notice.
We warrant our own labour against defects in workmanship. The period and what it covers are stated on your quote or invoice for that job.
The warranty doesn't cover: normal wear and tear; damage from misuse, neglect, accident, or acts of nature; work altered or repaired by someone else; failure caused by an existing condition we identified and you chose not to address; or issues arising from materials you supplied.
If something we installed isn't right, tell us. We'd rather come back and fix it.
Products we install carry their own manufacturer warranties, with terms set by the manufacturer, not by us. We install to manufacturer specification so those warranties stay valid. Claims under a manufacturer warranty are made against the manufacturer, though we'll help you with the process.
If you're a consumer under Ontario's Consumer Protection Act, 2002, you have rights that these Terms cannot take away:
Nothing in these Terms limits or waives any right you have under that Act or any other applicable consumer protection law.
To the extent the law allows, our total liability for any claim relating to work we've done is limited to the amount you paid us for that work. We are not liable for indirect or consequential losses — lost profit, lost rent, business interruption, or loss of opportunity.
This section does not limit liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited under Ontario law. It does not apply to your rights under the Consumer Protection Act, 2002.
Content on this site is provided for general information. Service descriptions are not offers, and prices are never quoted on this site. Nothing here forms a contract until we've given you a written quote and you've accepted it.
The Magna Integrated Services name, logo, text, images, and layout on this site belong to us and may not be copied, reproduced, or reused without our written permission. Manufacturer names and logos shown on this site are the property of their respective owners and appear only to indicate products we install.
When you give us your phone number or email address, you consent to us contacting you about your inquiry or your job by phone, email, or text.
To stop marketing messages, reply STOP to any text or use the unsubscribe link in any email. We action requests within 10 business days, as Canada's Anti-Spam Legislation requires. Messages about a job already underway — arrival times, scheduling, invoices — will continue. Message and data rates may apply.
How we handle your information is set out in our Privacy Policy.
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply in it. Any dispute will be dealt with by the courts of Ontario, and you agree to their jurisdiction. This does not affect your right to bring a claim in Small Claims Court or to use any dispute resolution route available to you under consumer protection law.
We may update these Terms from time to time. The current version is always the one on this page, with the date shown below. Changes don't affect a quote you've already accepted — that work stays governed by the Terms in force when you accepted it.
